Terms of Service
These terms define the operating rules for Swell workspaces, subscriptions, content, and publishing workflows.
Service Provider
Swell is a product of Forgewell, LLC, 56 Broad St STE 14266, Boston, MA 02109. By creating a workspace or using Swell, customers agree to use the service for lawful social media planning, scheduling, publishing, billing, and analytics workflows.
Legal Notices
Legal notices may be emailed to legal@growonswell.com or mailed to Forgewell, LLC, 56 Broad St STE 14266, Boston, MA 02109. Forgewell, LLC's registered agent is Legalinc Corporate Services Inc., 131 Continental Dr, Suite 305, Newark, DE 19713 US.
Accounts and Workspaces
Workspace owners are responsible for protecting credentials and ensuring scheduled content complies with applicable platform rules before publishing.
Subscriptions, Cancellation, and Refunds
Paid plans are managed through Swell billing. Plan limits may include social accounts, scheduled posts, analytics history, paid-ad accounts, revenue attribution, exports, and workspace features. Customers can manage or cancel eligible subscriptions through the customer portal. Cancellation stops future renewals but does not automatically refund the current billing period. Unless a separate written agreement says otherwise, fees already paid are non-refundable except where required by law or where Forgewell approves a courtesy refund for duplicate charges, billing errors, or material service failure.
Customer Content
Customers retain ownership of captions, uploaded media, tracked link data, and analytics exports they place in Swell. Customers grant Swell the limited rights needed to store, process, preview, schedule, publish, analyze, and export that content.
Intellectual Property and DMCA
Customers must have the rights needed for media, copy, trademarks, likenesses, data, and prompts they upload or generate through Swell. Forgewell may remove or disable access to content that appears to infringe intellectual property rights and may terminate repeat infringers. Copyright or DMCA notices should be sent to legal@growonswell.com with enough detail to identify the work, the allegedly infringing material, and the complaining party.
Acceptable Use
Customers may not use Swell to publish or generate unlawful, infringing, deceptive, abusive, hateful, harassing, sexually exploitative, malicious, spammy, privacy-invasive, or platform-prohibited content. Customers may not probe, overload, scrape, reverse engineer, resell, or bypass Swell security or plan limits. Customers are responsible for complying with social platform rules, ad disclosure duties, privacy obligations, intellectual property rights, and applicable laws.
AI-Generated Content
Customers are responsible for reviewing AI-generated images, video, audio, localization, and captions before use. Swell may send prompts, source media, and generation settings to configured AI providers only to produce the requested assets.
Privacy, Consent, and Replay
Customers are responsible for providing legally sufficient notices and obtaining any consent required before installing Swell analytics on their own sites. For paid traffic and public visitor funnels, Swell recommends requiring affirmative consent before persistent browser identifiers, autocapture, or session replay are enabled. Global text and input masking is a safety default, not permission to record sensitive experiences. Customers must block sensitive media, embedded content, and whole private regions and must not intentionally capture passwords, payment card data, health data, government identifiers, or private messages through replay.
Support Commitments
Standard support is available by email at support@growonswell.com. Forgewell aims to respond to paid customer support requests within two business days and to prioritize urgent security, billing, login, and publishing-impacting issues. Priority support, where included in a plan or written agreement, receives faster handling but is not a guaranteed service level agreement unless stated in that agreement.
Availability and Changes
Swell may evolve as platform APIs, billing rules, provider reviews, and product requirements change. Publishing and analytics features depend on valid provider access and may be limited by third-party platform availability. Swell is provided without a guaranteed uptime commitment unless a separate written agreement says otherwise.
